The Division of Consumer and Mortgage Lending of the Office of the State Bank Commissioner regulate the Kansas State Mortgage Broker Licensing. A Mortgage Company License to conduct mortgage business in Kansas is required by the Kansas Mortgage Business Act, K.S.A. 9-2201 et seq. Pursuant to this Act all parties conducting mortgage business in Kansas must be properly licensed with the Office of the State Bank Commissioner. Sole proprietorships, corporations, partnerships, or any other form of entity, however organized, who intend to conduct mortgage business in Kansas are required to obtain a license.
Following information is required to apply for a Kansas State Mortgage Broker License:
- It is not mandatory for the applicant to have a physical office location in Kansas.
- A completed, signed and dated application along with the appropriate attachments and fees should be submitted to the Office of the State Bank Commissioner for processing. Processing usually takes six to eight weeks.
- Licensing shall be renewed in each odd-numbered year. For instance, if the original application is approved in an even-numbered year it must be renewed in the following odd-numbered year. All applicants will receive written notification of the Commissioner's determination to approve or deny an application. Renewal forms are mailed at least sixty days prior to expiration.
- Each applicant or licensee who maintains a bona fide office is required to file with the commissioner a surety bond in the amount of $50,000. This bond must be issued by an insurance company authorized to conduct business in Kansas and should be able to secure the applicant's or licensee's faithful performance of all duties and obligations. And applicant or licensee not maintaining a bona fide office is required to file a surety bond in the amount of $100,000.
- Pursuant to the Kansas Mortgage Business Act, each individual registered as a Loan Originator must complete 8 credit hours of approved continuing education annually. Evidence of fulfillment of the continuing education requirement should be submitted on forms approved by the Office of the State Bank Commissioner.
