The Nebraska Department of Banking and Finance regulates the Nebraska State Mortgage Broker Licensing pursuant to the Mortgage Bankers Registration and Licensing Act. All activities conducted by mortgage lenders and/or brokers is termed "mortgage banking" in the State of Nebraska and an individual and/or business carrying out mortgage banking activities is referred to as a "mortgage banker". The Act is available at Mortgage Bankers Registration and Licensing Act, Chapter 45, Article 7.
The following information is required to obtain a Mortgage Broker License in Nebraska:
- Completed and signed application along with the non-refundable application fee must be submitted.
- Certain entities and/or transactions may be exempt from registration or licensing as a mortgage banker in the State of Nebraska. Refer to the Mortgage Bankers Registration and Licensing Act to obtain a list of exemptions.
- An original surety bond in the amount of $50,000 issued by a surety company authorized to do business in Nebraska is required.
- The applicant must submit the address and original written consent of an authorized registered agent located in Nebraska.
- The department will make its decision to grant or deny the license within 90 days of receiving the complete application package.
- Mortgage bankers/brokers that have a license or registration to operate within Nebraska must renew their licenses yearly by March 1. The renewal period begins the last week of December and ends March 1.
- There are no specific education or experience requirements mentioned in the Act for obtaining a Mortgage Broker License.
- The Department of Banking and Finance does not routinely require audited financial statements. However, they will request for the statements if they do require them.
- The Act specifically limits licensees to assessing only reasonable and necessary fees including actual charges incurred in connection with the making, closing, disbursing, servicing, extending, transferring, or renewing a loan. The licensees are required to clearly disclose all such fees and charges to the consumer, and also in compliance with any applicable federal law.
- Mortgage banker licenses in Nebraska are entity specific. If the entity has a license, any location of that entity may conduct mortgage banking business under that one license. Each branch does not need to have a separate license.
