The Mortgage Broker Act requires that all businesses offering mortgage broker
services in the State file with the South Carolina Department of Consumer Affairs.
The following information is required to obtain a Mortgage Broker License in
South Carolina:
- Submit a completed and signed application along with the application fee
and other required documents to the Department.
- It is required that the applicant has a physical office location in South
Carolina in order to operate under license in the state.
- An applicant must have at least two years' experience working as an originator
under the supervision of a mortgage loan broker before his initial license
is issued.
- The work experience requirement may be waived if the applicant shows proof
of the equivalent of six or more semester hours of satisfactorily completed
course work in related field.
- All licensed mortgage loan brokers must complete at least eight hours of
continuing professional education annually. Documentation of attendance at
the courses or correspondence courses completed must be maintained by the
mortgage loan broker and shall consist of a certificate of completion issued
by the teacher or sponsor of the course showing the recommended number of
hours of continuing professional education. Courses offered by the National
Association of Mortgage Brokers, the South Carolina Mortgage Brokers Association,
the department or courses related to real estate law or related law topics,
appraisals, mortgage lending, financial management, financial planning, or
mortgage processing are considered to qualify for continuing professional

- The applicants are required to submit their most recent financial statements
indicating net worth, dated not more than 180 days prior to the date of the
application and certified as true and correct by their dated signature or
audited.
- The applicant must submit a proposed copy of your mortgage broker fee agreement
which must comply with the Mortgage Loan Broker Regulation, S.C. Code Regs.
28-400C.
- The term of each license is one year. Licenses expire on September thirtieth
each year and must be renewed in a timely manner.
