The Wisconsin Department of Financial
Institutions regulates the Wisconsin State Mortgage Broker Licensing.
The following information is required to obtain a Mortgage Broker License in
the State of Wisconsin:
- You must submit a completed and signed application to the Department
along with application fees and other required documents.
- The Mortgage Broker License is valid for two years
- When applying the Department of Financial Institutions seeks verification
of all information within the application as well as supporting documents from
the individual applicant or at least two partners in a partnership firm. In
case of corporation, verification is sought from at least two officers of the
company who have the authority to verify. Similarly, in the case of LLC, two
members are required to verify all data. The verification procedure and rules
are in compliance with the Wisconsin Statute 224.72(2)
- If the applicant is a partnership, limited liability company or corporation,
the application is required to identify each partner, member or officer who
will use the title "mortgage broker". Any person who has not been
identified in the application can not act as a mortgage broker.
- If the applicant Corporation, LLC, or partnership was not formed in
Wisconsin, it must submit a Certificate of Authority. If not, it must provide
a waiver stating that they are exempt from providing such a Certificate of Authority.
If the applicant has a bona fide office then:
- The applicant must file a commercial surety bond with the division.
This bond should be issued by a surety company authorized to work in the state
of Wisconsin.
- A personal bond or third party guarantee in the form acceptable must
also be filed. This could be a Certificate of Deposit, a Debt Security, or an
irrevocable bank letter of credit issued by a financial institution that is
authorized to do business in Wisconsin.
- You also must establish a minimum net worth as required. Supporting
documents to prove the minimum net worth should be submitted.
If the applicant does not have a bona fide office then the amount of surety
bond as well as net worth is higher compared to the above case.
